1. Agreement and eligibility
These Terms of Service ("Terms") are an agreement between WeWoN Smart Sport Solutions LLC ("WeWoN", "we", "us") and anyone who visits this website, buys a service, uses a WeWoN application or takes part in a WeWoN program ("you"). By using our website or services you accept these Terms. If you accept on behalf of a school, club or other organization, you confirm you are authorized to do so. A signed service agreement, order form, Business Associate Agreement or pilot agreement controls if it expressly conflicts with these Terms.
You must be at least 18 years old to accept these Terms for yourself. AFE™ Safety Check is intended for users aged 15 and older; users under 18 may use WeWoN services only with the acceptance of a parent or legal guardian and, where applicable, under the supervision of their school or sports organization.
2. Services and intended use
WeWoN is a sports consulting firm with an educational and preventive focus ("We Learn. We Train. We Won."). Our services include assessments, program diagnosis, implementation of the WeWoN MatriX ecosystem, staff training, reports and season-long follow-up. Our applications help organize training plans, athlete records and physiological wellness information such as heart-rate recovery.
- Results are informational and operational. They must be interpreted in context by the responsible coach or professional.
- WeWoN does not replace coaches, athletic trainers, physicians or other licensed professionals, and does not practice medicine.
- When a result shows a marked deviation or the athlete reports symptoms, the coach should refer the athlete to a health professional according to the institution's protocol.
3. Your responsibilities
- Use WeWoN services only within your training, role and professional scope.
- Follow the published protocol, device instructions and safety conditions for every assessment.
- Provide accurate information and verify the correct athlete, date and conditions before acting on a result.
- Obtain every notice, permission and consent required by your organization or the law.
- Do not present a WeWoN result as a diagnosis, medical clearance or guarantee of safety or performance.
4. Minors, schools and consent
When services are delivered in schools or youth programs, the school or organization is responsible for obtaining parent or guardian consent and for any notices required by FERPA, COPPA, SOPIPA, Arkansas Act 754 or other applicable law. Student data is handled under the student-data rider of the applicable agreement and our Privacy Policy.
5. Free pilot programs
WeWoN may offer free pilot programs to schools and sports organizations. If you take part in a free pilot, by accepting these Terms you agree that anonymized data from your assessments, meaning data that cannot identify you, will belong to WeWoN Smart Sport Solutions LLC and may be used to research, validate and improve the AFE™ methodology and its tools. Anonymized pilot data is never sold and is never used for advertising. For participants under 18, these Terms must be accepted by a parent or legal guardian. Pilot features may change often and may have limited support.
6. Accounts and access
Each user must use an individual account and keep credentials private. Access to WeWoN tools may be provided through WeWoN MatriX or another approved sign-in service, and features depend on the role assigned to you. Tell us promptly about any suspected unauthorized access, lost device or misdirected report.
7. Purchases, quotes and refunds
- Individual assessments are sold at the price shown in our Store at the time of purchase. Team and institutional programs are quoted for each client and are governed by the signed order form.
- Payments are processed by third-party providers such as Stripe, Apple or Google; WeWoN does not receive full payment-card numbers.
- A completed assessment is not refundable because of an unfavorable or unexpected result. An assessment that cannot be completed because of a WeWoN error will be repeated or refunded.
- Any subscription will show its price, billing period and cancellation method before you are charged. Cancelling stops future renewals.
8. Privacy and data
Personal and physiological information is handled according to our Privacy Policy and any applicable agreement. Reports may contain sensitive information; share them only with authorized people through approved channels.
9. AI-assisted features
AI-assisted explanations, including WeOne, may be incomplete or wrong. They are suggestions for the coach or professional to review and are never medical advice or an automatic decision. Do not enter unnecessary identifying information into free-text AI features.
10. Acceptable use
- Do not copy, reverse engineer or try to derive WeWoN algorithms, scoring logic, protocols, software or trade secrets.
- Do not bypass access controls, credits or security measures, or access another person's or organization's data.
- Do not resell, sublicense or build a competing commercial service from WeWoN tools or materials without written permission.
11. Intellectual property
WeWoN and its licensors keep all rights in WeWoN MatriX, AFE™, WPM, WeOne, Team Builder, MatriX Planning, the WeWoN name and marks, methodologies, reports, documentation, designs and software. No ownership is transferred to you. If you send us suggestions, we may use them without obligation to you.
12. Development status and devices
Some WeWoN applications are in development. Readings are most reliable with a compatible Bluetooth heart-rate sensor or the web platform; Apple Watch support is experimental. Third-party devices, apps and services have their own terms, and we do not guarantee their accuracy or availability.
13. Disclaimers
To the maximum extent permitted by law, WeWoN services are provided "as is" and "as available". WeWoN disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement, and any warranty that a result will predict, prevent or rule out an injury, medical condition, emergency or performance outcome. Nothing in these Terms excludes a right that cannot lawfully be excluded.
14. Limitation of liability
To the maximum extent permitted by law, WeWoN is not liable for indirect, incidental, special, punitive or consequential damages, or for lost profits, data or goodwill. WeWoN's total liability for any claim is limited to the amount you paid WeWoN for the affected service in the twelve months before the event giving rise to the claim. A signed agreement may set different limits.
15. Indemnification
To the extent permitted by law, an organization using WeWoN services will defend and indemnify WeWoN against third-party claims caused by that organization's unlawful use, failure to obtain required consent, professional misconduct or breach of these Terms, except to the extent caused by WeWoN.
16. Suspension and termination
We may suspend access when reasonably necessary because of non-payment, a security risk, unlawful use or a material breach, with notice when practicable. Provisions on privacy, intellectual property, disclaimers, liability and disputes survive termination.
17. Governing law and disputes
These Terms are governed by the laws of the State of Arkansas and applicable federal law. Unless a signed agreement says otherwise, disputes will be heard in the state or federal courts serving Pulaski County, Arkansas. Before filing a non-urgent claim, both parties will try in good faith for at least 30 days to resolve it by written notice and direct discussion.
18. Changes and contact
We may update these Terms. The new version will show its effective date, and when required we will ask for renewed acceptance.
